Why Rule 31?

Rule 31 sets out requirements that all mediators must follow in court-annexed cases, regardless of whether they are Rule 31 listed.1 Using a Rule 31 listed mediator ensures that the mediator has completed the education and training requirements approved by the Alternative Dispute Resolution Commission, established by the Tennessee Supreme Court.

Under Rule 31, a mediator's role "includes, but is not limited to, assisting the parties in identifying issues, reducing obstacles to communication, maximizing the exploration of alternatives, and helping the parties reach voluntary agreements."2 A mediator cannot exhibit any bias toward any party involved and must "adhere to the highest standards of integrity, impartiality, and professional competence." 3

Using a Rule 31 listed mediator may be required in some circumstances. See Tenn. Code Ann. § 36-6-409(5).
